FERC Interest Determination definition

FERC Interest Determination means the FERC order or orders, including orders on rehearing, determining the amount of Interest Shortfall allocable to various Participants based on the ISO and PX settlement reruns and refund calculations and/or directing that interest be paid, regardless of whether such order or orders is/are subject to requests for stay, rehearing, or appeal, provided that such order or orders has/have not been stayed pending such rehearing or appeal.
FERC Interest Determination means the FERC order directing the payment of interest on receivables and refunds based on the ISO and PX settlement reruns and refund calculations, regardless of whether such order is subject to requests for rehearing or appeal; provided that such order has not been stayed pending such rehearing or appeal.
FERC Interest Determination means the FERC order or orders, including orders on rehearing, determining the amount of Interest Shortfall allocable to different entities

Examples of FERC Interest Determination in a sentence

  • If neither FERC nor the court of appeals specifies the time and manner for such payments, then such payments shall be made by wire transfer no later than 20 Business Days after the date that the applicable court of appeals order or FERC order on remand changing the FERC Interest Determination or the FERC Allowances Determination has become final and no longer subject to appeal.

  • As soon as practicable after issuance of the FERC Interest Determination, the California Parties shall pay to, or receive from, the ISO and PX, the difference between (a) the Estimated Interest on Receivables Amount less Settling Supplier’s Interest Shortfall Estimate previously withheld from distribution hereunder, and (b) the amount of interest that the FERC Interest Determination finds to be owing to Settling Supplier on such receivables.

  • No interest on refunds under this Settlement or on Reliant’s Receivables shall be released from the PX Settlement Clearing Account or paid to any Party or Opt-In Participant until the FERC Interest Determination has been issued and taken effect without being stayed.

  • If neither FERC nor the court of appeals specifies the time and manner for such payments, then such payments shall be made by wire transfer as soon as practicable after the date that the applicable court of appeals order or FERC order on remand changing the FERC Interest Determination or the FERC Allowances Determination has become final and no longer subject to appeal.

  • If neither FERC nor the court of appeals specifies the time and manner for such payments, then such payments shall be made by wire transfer within twenty (20) Business Days after the issuance of the FERC or court of appeals order (in each case that is a final order no longer subject to appeal) changing the FERC Interest Determination or the FERC Refund Determination, as applicable.

  • The amount of interest to be paid to Settling Participants associated with the refunds provided pursuant to this Agreement shall be determined in the FERC Interest Determination, provided that, to the extent amounts are held in the Mirant Refund Escrow, Settling Participants shall be paid interest on such amounts at the interest rate earned by that escrow account.

  • At such time, interest shall be paid to each Party or other Market Participant for refunds in accordance with the FERC Interest Determination.
