FERC Refund Determination definition

FERC Refund Determination means the FERC order or orders, in one or more of the FERC Proceedings establishing the obligations, if any, that Settling Supplier owes to Non-Settling Participants for the Settlement Period (or any portion thereof), and effectuating the payment of refunds, if any, taking into account all Mitigation, adjustments, disgorgement, charges, and allowances, or determining that Settling Supplier has no refund obligations to Non-Settling Participants regardless of whether such order or orders is/are subject to requests for stay, rehearing, or appeal, provided that such order or orders has/have not been stayed pending such rehearing or appeal.
FERC Refund Determination means the FERC order establishing the amount of Reliant Refunds owed to Non-Settling Participants, regardless of whether such order is subject to requests for stay, rehearing or appeal, provided that such order has not been stayed pending such rehearing or appeal.
FERC Refund Determination means the FERC order or orders, in the EL00-95 Proceeding, the Lockyer v. FERC Remand, the BPA v. FERC Remand, and/or the CPUC v. FERC Remand establishing the obligations, if any, that Settling Supplier owes to Non-Settling Participants for the Settlement Period (or any portion thereof), and effectuating the payment of refunds, if any, taking into account all Mitigation, adjustments, disgorgement, charges, and allowances, or determining that Settling Supplier has no refund obligations to Non-Settling Participants regardless of whether such order or orders is/are subject to requests for stay, rehearing, or appeal, provided that such order or orders has/have not been stayed pending such rehearing or appeal.

  • If FERC determines that Enron owes refunds pursuant to the FERC Refund Determination or interest pursuant to the FERC Interest Determination to any Non-Settling Participant, it shall be paid first from the amounts retained in relation to Non-Settling Participants in the Enron Refund Escrow, until such funds are exhausted, with any balance to be paid by Enron.

  • If the FERC Refund Determination is changed on rehearing, appeal, or remand in a way that changes the amount of refunds NCPA is ordered to pay to Non-Settling Participants, then, subject to Section 5.8, the California Parties shall be responsible for paying any increase in refunds owed to Non-Settling Participants and shall be entitled to the benefits of any decrease in refunds owed to Non- Settling Participants.
