First Data System definition

First Data System means the Software and Equipment owned or otherwise provided by First Data and used by First Data to perform the Services. The First Data System does not include Capital One Software or Equipment owned or leased by Capital One.
First Data System means the software, including the First Data Software, hardware, systems incorporating such software and hardware, documentation in any format and processes used to provide the Services. Table of Contents
First Data System means the First Data Software, Equipment and network connectivity and infrastructure provided by First Data to RFS or used by First Data to provide the Services (excluding network connectivity and infrastructure RFS provides under this Agreement).

  • In the event a Virus is found to have been introduced into the First Data System or other systems used by First Data to provide the Services, First Data shall use Commercially Reasonable Efforts at no additional charge to assist Capital One in reducing the effects of the Virus and, if the Virus causes a loss of operational efficiency or loss of data, to assist Capital One to the same extent to mitigate and restore such losses.

  • First Data represents and warrants that it shall use Commercially Reasonable Efforts so that no Viruses are coded or introduced into the First Data System or other systems used by First Data to provide the Services.

  • In the case of First Data, Confidential Information also shall include (1) First Data Software; (2) the First Data System; (3) all other Equipment and Software provided or used by First Data (other than those made available by Capital One), in each case, whether owned, licensed or otherwise provided or used by First Data (collectively, the “First Data Confidential Information”).

  • Each Table of Contents Resolution Agreement will propose options to overcome the described difference with the goal of meeting RCSI’s business requirements as efficiently as possible for both Parties, including through use of existing First Data System functionality where possible, and, for each option requiring system development, include a schedule for completion of programming as described in Schedule A, Section 2.3. • RCSI will determine the best course to follow.
