Nothing in this Agreement is intended to adversely affect the tax status of any Party including the status of NYISO, or the status of any Connecting Transmission Owner with respect to the issuance of bonds including, but not limited to, Local Furnishing Bonds.
Nothing in this LGIA is intended to adversely affect the CAISO’s or any Participating TO’s tax exempt status with respect to the issuance of bonds including, but not limited to, Local Furnishing Bonds.
This provision is applicable only to a Connecting Transmission Owner or Affected System Operator(s) that has financed facilities with tax-exempt bonds including, but not limited to, Local Furnishing Bonds (“Tax-Exempt Bonds”).
