GM Release definition

GM Release means a commercial release of PS OS Software designated as such by PalmSource in its sole discretion and made generally available by PalmSource to its licensees as a final golden master version of that PS OS Software.

  • Provided that Licensee has paid PalmSource the Maintenance and Support Fees (as defined in Section 5.2(b) (Ongoing Obligation)), during the term of this Agreement, PalmSource will provide Licensee with the Released Code in accordance with the provisions of Section 3.5 (Method of Delivery) for Updates, Upgrades and New Versions which PalmSource is required to provide under Section 7.1 below within thirty (30) days after Alpha Release, Beta Release and GM Release, respectively.

  • Notwithstanding the provision of any Alpha Release or Beta Release, Licensee shall not commercially release or distribute any PS Licensed Product until PalmSource provides the GM Release.

  • The provisions of the GUC Trust Approval Order concerning the GUC Trust Release, the New GM Release, the Excess Distribution and the Release Agreement are non-severable and mutually dependent, and no provision of the GUC Trust Approval Order shall be withdrawn, rescinded, reversed, vacated, or modified without the written consent of New GM and the GUC Trust.

  • The respective Licensee Product must be submitted for testing with the GM Release and only that version of the License Product containing the GM Release may be distributed once compatibility certification is obtained pursuant to subsection (a)(i) above.

  • PalmSource retains sole discretion over whether Modifications may be released and may change the Test Criteria in its sole discretion in response to Modifications by Licensee under Section 2.9 (Source Code), even if PalmSource has previously made other Test Criteria available for the same GM Release or makes different Test Criteria available for other licensees who do not make such Modification.

  • Releasing Parties and the New GM Releasing Parties expressly agree that the GUC Trust Release, the New GM Release, and the GUC Trust Approval Order are, shall be, and may be raised as a complete defense to, and shall preclude any action or proceeding encompassed by, the GUC Trust Release or the New GM Release.

  • For the avoidance of doubt, the New GM Release includes, but is not limited to, any and all claims for reimbursement, contribution, indemnity, or subrogation arising from New GM’s settlement of personal injury and wrongful death claims asserted in the Bankruptcy Case.

  • All parties involved in DUS work operating under a GM Release Consent must adhere to the instructions of the Release Consent Holder where necessary, to comply with the relevant consent conditions.

  • New Release means a modified or enhanced version of a Licensed Product that is designated by PTC as a new release of that product and that PTC makes generally available to its Maintenance Services customers.
