Home Depot Lease definition

Home Depot Lease shall have the meaning set forth in Section 2.11.15 hereof.
Home Depot Lease means that certain Ground Lease, dated February 14, 2000, as amended by First Amendment to Ground Lease, dated June 29, 2000, and as further amended by Second Amendment to Ground Lease, dated December 7, 2012, between Borrower (as successor-in-interest), as landlord, and Home Depot U.S.A., Inc., as tenant, demising a portion of the Property, as the same may have been amended or modified prior to the date hereof and may hereafter be amended or modified in accordance with the terms of this Agreement.
Home Depot Lease means that certain Triple Net Lease Agreement, dated as of September 4, 2009, between HD Phoenix, LLC (as predecessor-in-interest to Xxxxxxxx Borrower) and Home Depot (as amended, modified or supplemented from time to time).

  • This Declaration may be terminated by written notice recorded in the office of the Pima County, Arizona, Recorder executed by the Underlying Fee Owner, any mortgagee upon the Underlying Fee and Home Depot, and, upon expiration or termination of the Home Depot Lease, by the Underlying Fee Owner and any mortgagee upon the Underlying Fee acting alone.
