Host Indemnified Parties has the meaning set forth in Section 17.1. “Host Permits” has the meaning set forth in Section 7.1(b).

In addition to and without limiting the foregoing, Provider shall also defend, indemnify and hold harmless, the Host Indemnified Parties for any Losses to the extent caused by, arising from or out of any violation or alleged violation of Environmental Law by, arising from or out of Provider’s performance of the Work.
This indemnification obligation shall apply notwithstanding any negligent or intentional acts, errors or omissions of the Host Indemnified Parties but Supplier's liability under this indemnity shall be reduced in proportion to the percentage by which the Host Indemnified Parties negligence or intentional misconduct caused the damages.
