Housing Requirements. All requirements applicable to public housing, including, but not limited to, the Act, HUD regulations thereunder (and, to the extent applicable, any HUD-approved waivers of regulatory requirements), the ACC, the Mixed Finance ACC Amendment, the HOPE VI grant agreement (if applicable), HUD notices (including any notice of fund availability under which Landlord received an award of HOPE VI funds for use in connection with the Project), the HUD-approved Declaration of Restrictive Covenants in favor of HUD, the Authority’s admissions and occupancy policies applicable to the Project, as set forth in the Authority’s approved PHA Plan under 24 CFR part 903, and all applicable Federal statutory, regulatory and executive order requirements, as those requirements may be amended from time to time. HOPE VI Grant Agreement: The HOPE VI Revitalization Grant Agreement relating to the revitalization of the Project, by and between HUD and the Authority, dated as of , as may be amended.

  • The Affordable Housing Requirements shall terminate with respect to each such Phase of the Project, respectively, upon conclusion of the Affordable Housing Compliance Period for such Phase as set forth in the applicable ▇▇▇▇.

  • The obligation of Landlord to comply with Fair Housing Requirements inures to the benefit of the United States of America, HUD, State of North Carolina, and the Contractor, any of which will be entitled to affect any of the remedies available by law to redress any breach or to compel compliance by Landlord.

  • For example only, if the Workforce/Affordable Housing Units represent nineteen and one-half of one percent (19.5%) of the Total Housing Units in the Project, the percentage or Total Housing Units represented by Workforce/Affordable Housing Units shall be rounded up to twenty percent (20%) for purposes of determining satisfaction of these Affordable Housing Requirements.

  • The Affordable Housing Requirements are part of this Agreement, and the failure by Owner to comply with same shall be an Event of Default under this Agreement.

  • Failure to continuously satisfy the Affordable Housing Requirements results in prospective (and retroactive if applicable) loss of the Special Source Credits.

  • Should the Affordable Housing Requirements set forth in Section 3.03 below not be continuously satisfied following the first five (5) years of the Credit Period, after the cure period set forth in Section 5.01 herein, any Special Source Credits otherwise payable under this Agreement shall no longer be payable by the County, and this Agreement shall terminate.
