Independent Certifier definition

Independent Certifier has the meaning set out in Schedule 2 [Design and Construction Protocols];

Independent Certifier means the person appointed as the Independent Certifier pursuant to the Independent Certifier Agreement and as may be permitted pursuant to the Project Agreement.

Independent Certifier means such independent and reputable professional either as shall be jointly appointed by the Council and the Partner or who shall owe a duty of care to the Council to independently certify Practical Completion in relation to the Council Facilities

Examples of Independent Certifier in a sentence

• All instructions and representations issued or made by either of the Parties to the Independent Certifier shall be simultaneously copied to the other and both Parties shall be entitled to attend all inspections performed by or meetings involving the Independent Certifier.

• The identity of any such replacement shall be as agreed by the Parties and the terms of his/her appointment shall, unless otherwise agreed, be as set out in the Independent Certifier Agreement.

• The Parties agree that, notwithstanding the 30 days’ notice of termination, the Independent Certifier shall continue on a day-to-day basis thereafter until a new Independent Certifier is appointed.

• If such notice is given, then, pursuant to Section 23.7, a new Independent Certifier will be appointed.

• The Parties may agree to terminate the Independent Certifier Agreement upon 30 days notice to the Independent Certifier.

More Definitions of Independent Certifier

Independent Certifier means the independent certifier appointed by the Parties pursuant to clause 20 (Independent Certifier) and who is responsible for issuing the Completion Certificates declaring that the relevant Works have been completed;
