  • Except to the extent that a Change Certificate expressly requires otherwise, Project Co will implement a Change in accordance with all the terms of this Agreement, including Schedule 2 [Design and Construction Protocols], Schedule 3 [Design and Construction and Specifications] and Schedule 4 [Service Protocols and Specifications].

  • Within 30 days after the issuance of the 95% construction documents pursuant to Section 5.2(b)(3) (Design Process) of Schedule 2 [Design and Construction Protocols], the Authority will prepare and deliver to Project Co a consolidated Change Certificate encompassing all of the agreed Development Changes, as set out in the applicable Development Change Registers.

  • The exercise by the Authority of any of its rights under this Section 11 will not reduce or affect in any way Project Co’s responsibility under Section 3.1 of Schedule 2 [Design and Construction Protocols].

  • The constructional plant means all appliances, tools, plants or machinery or whatsoever nature required in or about the execution, completion or maintenance of the works but does not include materials or other things intended to form part of the permanent work.
