The Director of Finance shall transfer into and pay from the Series 2022 Excess Investment Earnings Account hereby created within the Wastewater Fund the amount of required arbitrage rebate, if any, due to the federal government pursuant to Section 148(f)(2) of the Tax Code, and the applicable Treasury regulations (the “Regulations”) promulgated thereunder.
The various accounts assigned to each fund could include any of the following depending upon the terms of the related debt obligation: Principal Account, Interest Account, Student Loan Account, Repayment Account, Debt Service Reserve Account, Investment Earnings Account, Rebate Account and General Investment Account.
The amounts, if any, in the Series 2022 Excess Investment Earnings Account are hereby appropriated for such purposes.
Upon receipt by the Enterprise of an opinion of nationally recognized bond counsel to the effect that the amount in the Excess Investment Earnings Account is in excess of the amount required to be therein pursuant to the provisions of the Tax Certificate, such excess shall be transferred to the Principal and Interest Account.
Permitted Investments so purchased as an investment of moneys in any such fund or account shall be deemed at all times to be a part of the applicable fund or account; provided that (with the exception of the Escrow Account and the Excess Investment Earnings Account) the interest accruing on such investments and any profit realized therefrom shall be credited to the Storm Drainage Fund, and any loss resulting from such investments shall be charged to the particular fund or account in question.
The moneys credited to the Principal and Interest Account, excluding investment earnings that may be required to be deposited in the Excess Investment Earnings Account or rebated to the federal government, shall be used to pay the Debt Service Requirements of the Bonds, any Additional Parity Bonds and any other Parity Securities then Outstanding, as such Debt Service Requirements become due, except as otherwise provided in this Ordinance.
All amounts in the Excess Investment Earnings Account, including income earned from investment thereof, shall be held by the Treasurer free and clear of any lien created by this Ordinance.
The Enterprise will cause amounts on deposit in the Excess Investment Earnings Account to be forwarded to the United States Treasury at the address and times provided in the Tax Certificate, and in the amounts calculated to ensure that the Enterprise’s rebate obligations are met.
Such Rebate Amounts shall be deposited annually in the Excess Investment Earnings Account created pursuant to the provisions of Section 804 of the Indenture.
