Medicare Part D Discount Information means information set forth in Exhibit A that will be sent from CMS or the Third Party Administrator (TPA), to the Manufacturer along with each quarterly invoice for the applicable drugs having NDCs with the Manufacturer’s FDA-assigned labeler code(s) received by applicable beneficiaries during a previous calendar quarter. This information will be derived from applicable data elements available on the prescription drug events (PDEs) as determined by CMS.
