Net Distributable Settlement Fund definition

Net Distributable Settlement Fund means the “Net Settlement Fund” less: (a) the amount of any award for attorney’s fees or attorney compensation approved by the Court and awarded to Plaintiffs’ Counsel; and (b) any interest earned and attributable to the amount of such award while in escrow.
Net Distributable Settlement Fund means the “Cash Fund” plus any interest earned on the Cash Fund, while in escrow, less the sum of (a) any incentive award approved by the Court and paid to the Class Representative; (b) any litigation expenses and/or costs approved by the Court and awarded to Class Counsel for this litigation or for ancillary matters.; and (c) any award of attorneys’ fees to Class Counsel.
Net Distributable Settlement Fund means the Cash Fund, plus any interest earned on the Cash Fund while in the QSF Account, minus the sum of any costs of notice and settlement administration, Incentive Award, Fee Award and other deduction from the Cash Fund approved by the Court.

Examples of Net Distributable Settlement Fund in a sentence

  • The amount of any incentive award approved by the Court, and any interest attributable to said amount while in escrow, shall be deducted from the Settlement Fund to determine the Net Settlement Fund from which any award of attorney’s fees to Plaintiffs’ Counsel shall be deducted before the balance is distributed to the LaSalle Settlement Class Members as the Net Distributable Settlement Fund in accordance with Schedule A.

  • To the extent any such LaSalle Settlement Class Member intervenes, such LaSalle Settlement Class Member shall be bound by this Agreement and will be entitled to receive only a pro rata payment from the Net Distributable Settlement Fund.

  • The amount of any such award, and any interest attributable to said amount(s) while in escrow, shall also be deducted from the Settlement Fund to determine the Net Settlement Fund from which any award of attorney’s fees to Plaintiffs’ Counsel shall be deducted before the balance is distributed to the LaSalle Settlement Class Members as the Net Distributable Settlement Fund in accordance with Schedule A.

  • Qualified Settlement Fund or “Settlement Fund” means the interest-bearing, settlement fund account to be established and maintained by the Escrow Agent in accordance with Article 5 herein and referred to as the Qualified Settlement Fund (within the meaning of Treas. Reg. § 1.468B-1).

  • Cash Settlement Amount means the “Cash Settlement Amount” as determined by the Calculation Agent in accordance with Paragraph 6.

  • Gross Settlement Amount means $633,000.00 which is the total amount Defendant agrees to pay under the Settlement except as provided in Paragraph 9 below. The Gross Settlement Amount will be used to pay Individual Class Payments, Individual PAGA Payments, the LWDA PAGA Payment, Class Counsel Fees, Class Counsel Expenses, Class Representative Service Payment and the Administrator’s Expenses.

  • Tax Distribution Amount means, with respect to a Member’s Units, whichever of the following applies with respect to the applicable Tax Distribution, in each case in amount not less than zero:

  • Cash Settlement Date means, for each Financially Settled Futures Transaction, the Business Day determined by Exchange from time to time in accordance with industry practice for such Transaction, as posted on Exchange’s Website not less than one month prior to the occurrence of such date, other than Invoices issued as a result of a Contracting Party’s Default or under the Close- out Procedure which amounts require payment immediately;
