New Release Title definition

New Release Title means any Title first Released theatrically anywhere in the world after the Effective Date of this Agreement and published as Licensed Content Product on a LCP Unit or Interim LCP Unit.
New Release Title means any SPHE theatrical, direct-to-video or made-for-television feature-length motion picture on any Qualifying Format that is purchased by Fry’s during the Term within twenty-six (26) weeks following the initial home entertainment release date on any Qualifying Format (“Street Date”) for such title. A “Catalog Title” means any SPHE theatrical, direct-to-video or made-for-television feature-length motion picture on any Qualifying Format that is purchased by Fry’s during the Term more than twenty-six (26) weeks following the Street Date on any Qualifying Format for such title. A “TV Title” means any SPHE serial audiovisual work originally created for television and made available on any Qualifying Format that is purchased by Fry’s during the Term. New Release Titles, Catalog Titles and TV Titles are collectively referred to herein as “Titles.”. Each of the following periods during the Initial Term shall be referred to as a “Quarter”: April 30, 2012 to July 29, 2012 July 30, 2012 to October 28, 2012 October 29, 2012 to January 27, 2013 January 28, 2013 to April 28, 2013 April 29, 2013 to July __, 2013 After the Initial Term, each Quarter shall be determined in accordance with the applicable SOW. Placement Rebates will be paid in the form of a credit authorization issued by SPHE to Fry’s. SPHE will use commercially reasonable efforts to issue credit authorization to Fry’s no later than forty-five (45) days after the end of each Quarter, provided that SPHE has received the applicable reporting from Fry’s and completed returns processing. Fry’s agrees not to charge back or take any deductions until such credit authorization is provided by SPHE. Any adjustments to a Placement Incentive for a given Quarter will be calculated and deducted or otherwise withheld as an offset by SPHE against (x) the Placement Incentive applicable to the next Quarter or (y) against any amounts payable or otherwise owed by SPHE (or any subsidiary, parent or affiliate thereof) to Fry’s.

Related to New Release Title

  • New Release means a partial or complete replacement of the executable code of the Software in machine-readable form, which may provide new features or functions. A New Release may incorporate some or no enhancements. A New Release involves only such alterations that change the release number to the immediate right of the decimal point. Changes to the release number are made solely at the discretion of the Licensor.

  • Pre-Release shall have the meaning set forth in Section 2.09.

  • Maintenance Release means any update, upgrade, release or other adaptation or modification of the Software, including any updated Documentation, that Contractor may generally provide to its licensees from time to time during the Term, which may contain, among other things, error corrections, enhancements, improvements or other changes to the user interface, functionality, compatibility, capabilities, performance, efficiency or quality of the Software.

  • Pre-Release Transaction shall have the meaning set forth in Section 5.10.

  • Escrow Release Date has the meaning set forth in Section 9.6.

  • Escrow Release Conditions has the meaning set forth in the Escrow Agreement.

  • Minor Release means an incremental release of Software that provides maintenance fixes and additional Software functions. Cisco designates Minor releases as a change in the tenths digit of the Software version number [x.(x).x].

  • Owner’s Title Policy means those certain ALTA extended coverage owner’s policies of title insurance issued in connection with the closing of the Mortgage Loan insuring the Mortgage Borrower as the owner of the Property.
