Operations Performance Bond definition

Operations Performance Bond means the performance bond to be provided by the DBOM Contractor as an Acceptance Date Condition in accordance with the terms and conditions set forth in this Service Agreement and in the form set forth in the Transaction Forms.
Operations Performance Bond means the performance bond to be provided by Veolia with the Company and the Village as co-obligees, as of the Acceptance Date for the Operations Period in accordance with the terms and conditions set forth in this Agreement and in the form set forth in Appendix 4.
Operations Performance Bond means the operations performance bond provided in accordance with Section 14.2 (Operations Performance Bonds) and substantially in the form set forth in the Transaction Forms.

Examples of Operations Performance Bond in a sentence

  • If the Operations Performance Bond expires or is terminated prior to the expiration of this Service Agreement, prior to such expiration or termination, the DBOM Contractor shall provide a substitute Operations Performance Bond in the amount and in accordance with the provisions of this subsection such that there is no gap in coverage.

  • Pursuant to Section 9.3 (Acceptance Date Conditions), the DBOM Contractor must provide the Operations Performance Bond as an Acceptance Date Condition issued by a Surety (or Sureties) meeting the qualification requirements set forth in subsection (C) (Surety Requirements) of this Section and in the form attached as a Transaction Form hereto.

  • The CONCESSIONAIRE may, in lieu of the Operations Performance Bond, but subject to the above conditions set forth in this Article, deposit with the CITY an irrevocable letter of credit or cash deposit in the amount equal to six (6) times the Rent.

  • Until the Payment Bond, the Design-Build Performance Bond or the Operations Performance Bond, as applicable, required of such additional Surety is furnished, the BWS shall have the right to suspend payments under this Service Agreement.

  • The BWS shall have the right at any time to release the DBOM Contractor from its obligation to provide the Operations Performance Bond required under this Article.

  • In no event shall the Operations Performance Bond serve as a limitation on the liability of the DBOM Contractor under this Service Agreement.

  • This Operations Performance Bond will be conditioned solely upon the full and faithful performance of all covenants of this Concession Agreement.

  • Whenever the BWS deems the Surety (or Sureties) to be inadequate, it may, upon written demand, require the DBOM Contractor to furnish an additional Surety to provide the Payment Bond, the Design-Build Performance Bond or the Operations Performance Bond, as applicable, that meets the qualification requirements set forth in this subsection to cover any remaining and applicable Contract Services.

  • The Operations Performance Bond shall serve as security for the performance of the Operation Services by the DBOM Contractor, and shall be in the initial stated amount equal to the annual Service Fee, shall be for a term of one year, and shall be continuously renewed, extended or replaced so that it remains in effect for the entire Term; provided, however, that the initial stated amount of the Operations Performance Bond shall be adjusted on July 1 of each Contract Year by the by the CPI Adjustment Factor.

  • The Operations Performance Bond for the first year's operation shall be submitted to the CITY before the commencement of operations at the Facility by CONCESSIONAIRE.

  • Performance Bond means the financial security for performance a USF Service Provider must furnish in accordance with section 54 of this RFA;

  • Energy Performance Score means the numeric rating generated by Portfolio Manager that compares the Energy usage of the building to that of similar buildings.

  • energy performance contracting means a contractual arrangement between the beneficiary and the provider of an energy efficiency improvement measure, verified and monitored during the whole term of the contract, where investments (work, supply or service) in that measure are paid for in relation to a contractually agreed level of energy efficiency improvement or other agreed energy performance criterion, such as financial savings;

  • Extreme performance coating means coatings designed for harsh exposure or extreme environmental conditions.

  • Capacity Performance Resource means a Capacity Resource as described in Tariff, Attachment DD, section 5.5A(a).

  • Energy savings performance contract means a public contract between a contracting agency and a qualified energy service company for the identification, evaluation, recommendation, design and construction of energy conservation measures, including a design-build contract, that guarantee energy savings or performance.

  • Annual performance report means a written appraisal of the teaching staff member's performance prepared by the teaching staff member’s designated supervisor based on the evaluation rubric for his or her position.

  • Financial Performance Covenants means the covenants of the Borrower set forth in Sections 6.10 and 6.11.

  • Long-Term Performance Award means an award under Section 10 below. A Long-Term Performance Award shall permit the recipient to receive a cash or stock bonus (as determined by the Committee) upon satisfaction of such performance factors as are set out in the recipient's individual grant. Long-Term Performance Awards will be based upon the achievement of Company, Subsidiary and/or individual performance factors or upon such other criteria as the Committee may deem appropriate.

  • Cash Performance Award means an Award that is denominated by a cash amount to an Eligible Person under Section 10 hereof and payable based on or conditioned upon the attainment of pre-established business and/or individual Performance Goals over a specified performance period.

  • Financial Performance Covenant means the covenant set forth in Section 6.10.

  • Key Performance Indicators or “KPIs” means the performance measurements and targets set out in Part 3 of Schedule 1 (Services) of this Framework Agreement;

  • Performance audit means an objective and systematic assessment of a state agency or agencies or any of their programs, functions, or activities by the state auditor or designee in order to help improve agency efficiency, effectiveness, and accountability. Performance audits include economy and efficiency audits and program audits.

  • Performance Requirements The ordering entity reserves the right to inspect and verify that all deliveries are in accordance with specifications, both at the point of delivery and at the point of use. For orders that specify an “authorized party” to receive and inspect deliveries and/or installations, acceptance and inspection procedures must be performed by the” authorized party” to be considered and accepted by the ordering entity. Products inspected at the time of use are subject to refusal and return requirements for issues of quality such as defects in manufacturing and/or workmanship. Products will not be considered accepted by the ordering entity until the installation is complete for the applicable products.

  • Additional Performance Security means the Bank Guarantee to be submitted by Successful Bidder in accordance with Clause 8.7 of this RFP Document

  • Vehicle measuring attitude means the position of the vehicle as defined by the co-ordinates of fiducial marks in the three-dimensional reference system.

  • Total Performance means that the entire Work, except those items arising from the provisions of any warranty, have been performed in accordance with the Contract;

  • Eligible Renewable Energy Resource or “ERR” has the meaning set forth in California Public Utilities Code Section 399.12 and California Public Resources Code Section 25741, as either code provision is amended or supplemented from time to time.

  • Performance Bonus means the performance bonus in respect of each Class payable to the General Partner by the Partnership which will be equal to 20% of the product of: (a) the number of Units of that Class outstanding on the Performance Bonus Date; and (b) the amount by which the Net Asset Value per Unit of that Class on the Performance Bonus Date (prior to giving effect to the Performance Bonus) plus the aggregate value of all distributions per Unit of that Class during the Performance Bonus Term exceeds $25.00.

  • Performance Report has the meaning set out in clause 8.2;

  • Performance Compensation Award means any Award designated by the Committee as a Performance Compensation Award pursuant to Section 11 of the Plan.

  • Performance Monitoring System has the meaning given to it in paragraph 1.1.2 in Part B of Schedule 6 (Service Levels, Service Credits and Performance Monitoring);

  • Qualified Performance-Based Compensation means any compensation that is intended to qualify as “qualified performance-based compensation” as described in Section 162(m)(4)(C) of the Code.
