To the extent of any payment so made, the Original Debt shall be treated as if it had not been discharged.
This provision is not intended to apply to consensual restructurings of Original Debt due to non-payment of Original Debt that results in an accrual of past due scheduled annual debt service, and is not intended to require the Collateral Agent or the Secured Parties to exercise remedies.
The Collateral Agent shall have the right to assign its interest in this Consent to any person or entity to whom the Original Debt is transferred, provided such transferee assumes the obligations of the Borrower (or the Collateral Agent, as the case may be) under this Consent.
