Pennsylvania Mine Area has the meaning set forth in the recitals to this Agreement.

Pennsylvania Mine Area as defined in the Cooperation and Safety Agreement, is hereby modified to mean the area designated and shown on Exhibit A attached hereto, and Exhibit A attached to the Cooperation and Safety Agreement shall be deemed stricken and replaced with Exhibit A attached to this First Amendment; thereby expanding the Pennsylvania Mine Area to include the additional lands described on Exhibit A-1 attached hereto (the “Expansion Area”).

Examples of Pennsylvania Mine Area in a sentence

  • Gas Party shall not release, terminate, exchange, assign, or in any manner compromise Coal Party’s claims to Coal Interests in the Pennsylvania Mine Area without the prior written approval of Coal Party.

  • Coal Party shall not release, terminate, exchange, assign, or in any manner compromise Gas Party’s claims to Coal Gas within the Pennsylvania Mine Area without the prior written approval of Gas Party.

  • Coal Party shall provide written notice to Gas Party not more than thirty (30) Business Days after Coal Party’s purchase, lease, or other acquisition of any Gas Interests within the Pennsylvania Mine Area (“Coal Notice”), and, at Gas Party’s written election delivered to Coal Party within thirty (30) Business Days after Gas Party’s receipt of a Coal Notice, the Parties shall enter into an agreement for the purchase of such interests in a mutually agreeable form.

  • Except as otherwise expressly amended and restated herein as to the Pennsylvania Mine Area, the MCSA remains in full force and effect as to all other areas outside the Pennsylvania Mine Area.

  • Subject to and to the extent not prohibited by or covered under Existing Permits/Agreements, Coal Party grants to Gas Party the sole, exclusive, and irrevocable right and option (“Gas Party Option”) to purchase and acquire any Gas Interests to the extent such Gas Interest (including, for the avoidance of doubt, Coal Gas contained in any coal seam) is purchased, leased, or otherwise acquired by Coal Party after the Execution Date within the Pennsylvania Mine Area.

  • For the avoidance of doubt, except as set forth in the Omnibus Agreement, in no event shall any Party have any liability under this Agreement or applicable Law for any claim, damage, loss, or liability sustained or incurred in connection with its operations with respect to the Pennsylvania Mine Area or any breach of any provision of this Agreement.

  • Gas Party or Coal Party may terminate this Agreement if, within the Pennsylvania Mine Area, there are (i) no active mining operations by Coal Party and (ii) no active gas operations by Gas Party.

  • Each Party shall conduct its operations in the Pennsylvania Mine Area in a good and workmanlike manner, in accordance with good and safe practices and standards for the type of work being conducted as a reasonably prudent operator operating under similar circumstances and in a manner that does not constitute gross negligence or willful misconduct.

  • The Parties shall cooperate in good faith to seek to maximize coal and gas production from the Pennsylvania Mine Area.

  • Subject to and to the extent not prohibited by or covered under Existing Permits/Agreements, Gas Party and the CEI Subsidiaries grant to Coal Party the sole, exclusive, and irrevocable right and option (“Coal Party Option”) to purchase and acquire any coal seam and/or associated mining rights purchased, leased, or otherwise acquired by Gas Party or any of the CEI Subsidiaries after the Execution Date within the Pennsylvania Mine Area.

  • AT&T KENTUCKY means the AT&T owned ILEC doing business in Kentucky.

  • AT&T MISSOURI means the AT&T owned ILEC doing business in Missouri.

  • AT&T MISSISSIPPI means the AT&T owned ILEC doing business in Mississippi.

  • CONE Area means the areas listed in Tariff, Attachment DD, section 5.10(a)(iv)(A) and any LDAs established as CONE Areas pursuant to Tariff, Attachment DD, section 5.10(a)(iv)(B).

  • ILUA Area means the geographical area in relation to which the Framework ILUA applies, as specified in Schedule 2 of the Framework ILUA;

  • AT&T LOUISIANA means the AT&T owned ILEC doing business in Louisiana.

  • Natural area means an area of the rural or non-urban environment which is in an unspoilt natural state or is of high scenic value, and includes, but is not limited to, national parks, game reserves, nature reserves, marine reserves, wilderness areas, areas of extensive agriculture and scenic areas.

  • Storage area means any location, facility, or vehicle which is used to store, to transport, or to secure a radiographic exposure device, a storage container, or a sealed source when it is not in use and which is locked or has a physical barrier to prevent accidental exposure, tampering with, or unauthorized removal of the device, container, or source.

  • Coastal area means coastal area as defined in section 22a-93(3) of the Connecticut General Statutes. “Coastal waters” means coastal waters as defined in section 22a-93(5) of the Connecticut General Statutes. “Commissioner” means commissioner as defined in section 22a-2(b) of the Connecticut General Statutes.

  • AT&T KANSAS means the AT&T owned ILEC doing business in Kansas.

  • State of Texas Textravel means the information maintained on the Texas Comptroller of Public Accounts’ website relative to travel reimbursements under this Contract, if any.

  • Area of use means a portion of an address of use that has been set aside for the purpose of receiving, preparing, using, or storing radioactive material.

  • South Caucasus/Central and South Asian (SC/CASA) state means Armenia, Azerbaijan, Georgia, Kazakhstan, Kyrgyzstan, Pakistan, Tajikistan, Turkmenistan, or Uzbekistan.

  • AT&T SOUTH CAROLINA means the AT&T owned ILEC doing business in South Carolina.

  • AT&T CONNECTICUT means the AT&T-owned ILEC doing business in Connecticut.

  • Permit area means the area constituted by the blocks that are the subject of a permit;

  • Carpet Area means the net usable floor, area of an Flat/Apartment, excluding the area covered by the external walls, areas under services shafts, excluding balcony or verandah area and exclusive open terrace, but includes the area covered by the internal partition walls of the flat/apartment;

  • Coastal zone means the area comprising coastal public property, the coastal protection zone, coastal access land, coastal protected areas, the seashore and coastal waters, and includes any aspect of the environment on, in, under and above such area;

  • Area of Specialty means the description of an MBE or WBE firm’s business which has been determined by the Chief Procurement Officer to be most reflective of the MBE or WBE firm’s claimed specialty or expertise. Each MBE/WBE letter of certification contains a description of the firm’s Area of Specialty. This information is also contained in the Directory (defined below). Credit toward this Contract’s MBE and WBE participation goals shall be limited to the participation of firms performing within their Area of Specialty.

  • South Caucasus/Central and South Asian (SC/CASA) state means Armenia, Azerbaijan, Georgia, Kazakhstan, Kyrgyzstan, Pakistan, Tajikistan, Turkmenistan, or Uzbekistan.

  • Use Zone means the area beneath and surrounding a play structure or piece of equipment that is designated for unrestricted movement around the equipment, and onto which a child falling from or exiting the equipment could be expected to land.

  • State waters means all water, on the surface and under the ground, wholly or partially within or bordering the Commonwealth or within its jurisdiction, including wetlands.

  • Zone 3 means all of that part of the Lower Peninsula south of the line described in subdivision (bb).

  • Urban area means Maricopa and Pima counties, excluding Tribal Lands.

  • Transit village means a community with a bus, train, light rail,

  • Geothermal energy means energy contained in heat that continuously flows outward from the earth that is used as the sole source of energy to produce electricity.
