Pharmaceutical Use definition

Pharmaceutical Use means a Licensed Product intended for use only in the diagnosis, cure, mitigation, and/or prevention of disease or treatment and Approved for such use by a government entity such as the U.S. Food and Drug Administration (“FDA”) including, but not limited to, smoking cessation products. For avoidance of doubt, “Pharmaceutical Use” does not include Licensed Products sold without a medical prescription but authorized for sale by the FDA as a modified risk tobacco product.
Pharmaceutical Use means the treatment or prophylaxis of a human or animal condition pursuant to a regulatory approval specific to such condition. “SADC” means the Southern African Development Community, a regional economic community, which, as of the Effective Date, [***]. If the SADC adds member states during the Term of this Agreement, such additional member states shall be included in the meaning of SADC as that term is used herein upon Xxxxx’s written request to Dyadic to make such addition, provided that at the time of such request Xxxxxx has no contrary obligations to any third party. If any member states of the SADC as of the Effective Date leave the SADC during the Term of this Agreement, such former member states shall nonetheless be included in the meaning of SADC as that term is used herein.
Pharmaceutical Use means an application of the Device which requires regulatory approval to market either (a) the Device, (b) a Product, or (c) EPHI Technology, for such application in the Territory. For the avoidance of doubt, Pharmaceutical Use shall not include, and EPHI shall have no rights to, any application of the Device and/or Product for Cosmetic Use.
