Pricing Error definition

Pricing Error means a misquote by us where the price quoted materially and clearly deviates from the prevailing Underlying Market price (or the forward calculated market price) at the time that it was quoted.

Examples of Pricing Error in a sentence

• In deciding whether an error is a Pricing Error we may take into account any relevant information including the state of the Underlying Market at the time of the error or any mistake in, or lack of clarity of, any information source or pronouncement upon which we base our quoted prices.

• From time to time a Pricing Error may occur (including circumstances outside our control) which prevents our Range Spreads Platform from determining the Price for a Range Spreads Contract.

• The contract is binding on both parties except for instances of a Pricing Error.

• If we become aware of a Pricing Error during the life of the Range Spreads Contract, we may, provided it is fair and reasonable in the circumstances, declare that Range Spreads Contract void and return the funds you invested to your Account.

• In the absence of wilful default or fraud by us we will not be liable towards the client for any loss, cost, claim, demand or expense following a Pricing Error (including where the Pricing Error is made by any information source, commentator or official upon whom we reasonably rely).
