Public aircraft are those aircraft meeting the definition in 49 U.S.C. §§ 40102 and 40125.
Public aircraft means an aircraft used only for the United States Government, or an aircraft owned and operated (except for commercial purposes) or exclusively leased for at least 90 continuous days by a government other than the United States Government, including a State, the District of Columbia, a territory or possession of the United States, or a political subdivision of that government.
Public aircraft are defined in 49 U.S.C. § 40102(a)(41) (see Appendix A).
On October 25, 1994, the President signed the Independent Safety Board Act Amendments, which contained a major change in the definition of “public aircraft.” Public aircraft are exempt from many types of Federal Aviation Administration (FAA) regulations.
Public aircraft status means, among other things, that an aircraft will not be subject to some of the regulatory requirements applicable to “civil” (or civilian) aircraft.
