In the event that TIPS receives a written request for information pursuant to the Public Information Act that affects Vendor’s interest in any information or data furnished to TIPS by Vendor, and TIPS requests an opinion from the Attorney General, Vendor may, at its own option and expense, prepare comments and submit information directly to the Attorney General stating why the requested information is exempt from disclosure pursuant to the requirements of the Public Information Act.
If Contractor believes information or materials submitted to Port San Antonio constitute trade secrets, proprietary information or other information that is excepted from disclosure under the Public Information Act, Contractor will be solely responsible for specifically and conspicuously designating that information by placing “CONFIDENTIAL” in the center header of each such page affected, as it determines to be appropriate.

PROVIDER acknowledges that A&M System is obligated to strictly comply with the Public Information Act, Chapter 552, Texas Government Code, in responding to any request for public information pertaining to this Agreement, as well as any other disclosure of information required by applicable Texas law.
Nothing contained in this section will modify or amend requirements and obligations imposed on Port San Antonio by the Public Information Act or other applicable law, and the provisions of the Public Information Act or other laws will control in the event of a conflict between the procedures described in this section and the applicable law.
