Qualified Decommissioning Funds definition

Qualified Decommissioning Funds means the external trust fund that meets the requirements of Code Section 468A and Treas. Reg. 1.468A-5, maintained by Seller with respect to the Facilities prior to Closing pursuant to Seller's Decommissioning Trust Agreements and maintained by Buyer after the Closing pursuant to the Post-Closing Decommissioning Trust Agreements to the extent assets are transferred to such fund by Seller pursuant to Section 6.12.

"Radioactive Waste Material" means Radioactive Material which is no longer fit for its intended purpose or has been disposed of or Released into the Environment except as authorized by applicable Laws. Radioactive Waste Material shall include any substance that is both Hazardous Material and Radioactive Material but shall not include Spent Nuclear Fuel. "Real Property" has the meaning set forth in Section 2.1(a). "Receiving Party" has the meaning set forth in the definition of Proprietary Information. "Related Agreements" means the Deeds, Assignment and Assumption Agreements, Bills of Sale, Asset Demarcation Agreement, Interconnection Agreement, Releases of Mortgage Indenture, Interim Services Agreement, Lead Participant Rights Agreement, Acceptable Credit Support and, if applicable, the DTC Guarantee and the DOE Acceptable Credit Support. "Release" means any actual, threatened or alleged spilling, leaking, pumping, pouring, emitting, dispersing, emptying, discharging, injecting, escaping, leaching, dumping, or disposing of any Hazardous Substance into the Environment or within any building, structure, facility or fixture, that may cause an Environmental Liability (including the disposal or abandonment of barrels, containers, tanks or other receptacles containing or previously containing any Hazardous Substance). -112-

Related to Qualified Decommissioning Funds

  • Operating Fund means a fund in which the revenues and expenditures are subject to appropriation control.

  • Participating Funds means those Funds that are parties to a particular repurchase transaction effected through the Joint Trading Account.

The plan is prepared by the nuclear facility license holder and is reflected in the multiannual work programmes of the Programme;

  • Trust Funds means any cash or Permitted Investments comprised of (a) funds specially and exclusively used (i) for payroll and payroll taxes and other employee benefit payments to or for the benefit of employees of Loan Parties and their subsidiaries, (ii) to pay all taxes required to be collected, remitted or withheld (including, without limitation, federal and state withholding taxes (including the employer’s share thereof)) and (b) any other funds which any Loan Party holds on behalf as an escrow or fiduciary for another person (other than another Loan Party).

The AIFM will confirm to the Central Bank that any new Category 2 investment funds will comply in all material respects with the requirements applicable to a Retail Investor Alternative Investment Fund pursuant to the AIF Rulebook. In the case of unregulated funds, these will be domiciled in Australia, Hong Kong, South Africa, Bermuda, British Virgin Islands, the Cayman Islands, Singapore or Mauritius and will follow an investment strategy that seeks to provide capital appreciation to its investors through direct investment in transferable securities in the form of cash and/or cash equivalents, global equities (such as shares and common stock) and global equity related securities (securities with equity characteristics or conferring the right to acquire equity securities, such as depositary receipts and preference shares), REITs and global bonds which are listed on Recognised Markets (as set out in Appendix II of the Prospectus). Underlying Funds may not be leveraged. The Underlying Funds must comply with the investment restrictions of the Fund as outlined below.

  • Company Contribution Account means (i) the sum of the Participant’s Company Contribution Amounts, plus (ii) amounts credited or debited to the Participant’s Company Contribution Account in accordance with this Plan, less (iii) all distributions made to the Participant or his or her Beneficiary pursuant to this Plan that relate to the Participant’s Company Contribution Account.

  • Program Funds means all funds that are required to be deposited into the Non-profit School Food Service Account.
