  • The City shall cooperate and reasonably assist the Owner in (a) securing approval from the TCEQ to obtain one hundred percent (100%) reimbursement of the cost to construct the Regional Stormwater Facility and (b) securing all governmental approvals necessary in relation to the construction of the Regional Stormwater Facility.

  • In the event the City receives additional fees after the District has received the above specified percentage of the total construction cost of the Regional Stormwater Facility, the City may retain such excess fees.
