Related Insurance Claim definition

Related Insurance Claim means (i) any Claim by any Person against any Protected Party or a Settling Insurer Entity that, directly or indirectly, arises from, relates to, or is in connection with a Tort Claim, including any such Claim for defense, indemnity, contribution, subrogation, or similar relief or any direct action or claim, including an action or claim under Minn. Stat. § 60A.08, subd. 8; and (ii) any Extra-Contractual Claim.

  • As provided in the Insurance Settlement Agreements, each Settling Insurer agrees that it will not pursue any Related Insurance Claim that it might have against any other Settling Insurer that does not assert a Related Insurance Claim against a corresponding Settling Insurer.

  • To ensure that such a reduction is accomplished, the Settling Insurer Entities shall be entitled to assert this provision as a defense to any action against them brought by any Other Insurer and shall be entitled to request that the court or appropriate tribunal issue such orders as are necessary to effectuate the reduction to protect the Settling Insurer Entities from any liability for the Related Insurance Claim.

Related Insurance Claim means any Claim against a Settling Insurer that, directly or indirectly, relates to a Tort Claim or a Claim against any of the Protected Parties, or against any other Person or Entity covered by the Insurance Policies or Certificates, to the extent such Claim, directly or indirectly, arises out of, relates to, or is in connection with the same injury, damages, facts or circumstances giving rise to a Tort Claim, including an Unknown Tort Claim, or the actual or alleged coverage thereof under the Insurance Policies or Certificates, including: (i) any Claim for defense, indemnity, reimbursement, contribution, subrogation, or similar relief; (ii) any Extra-Contractual Claim or other Claim associated with any Extra-Contractual Claim; (iii) any Direct Action Claim; (iv) any Claim for contribution toward or reimbursement of a Medicare Claim; and (v) any other derivative or indirect claim of any kind whatsoever.
