• Nothing in this Contract confers on the Operator any proprietary right in the Relevant Infrastructure.

• Subject to Project Company complying with its obligations under Section 19.6(a) in the case of Vehicle Damage, if the loss or damage to the Relevant Infrastructure is caused by a Compensable Delay Event, a Compensable Relief Event or Vehicle Damage and MDOT requires Project Company to repair or rebuild the Relevant Infrastructure, then subject to the express terms of this Agreement, Project Company may submit a claim under Article 29 or Article 30 (as applicable).

• In the eventuality of the termination of a Relevant Infrastructure Lease, Aurizon Network would no longer provide access and receive access charges, and the Trustee would no longer receive a payment stream.

• At the Expiry Date, Project Company must certify that Elements of the Relevant Infrastructure comply with the Residual Life, testing, inspection and reporting requirements defined in the Agreement, and specifically in Exhibit C.
