If the Requesting Air Transportation Company’s attempt to obtain voluntary Signatory Passenger Airline accommodation proves unsuccessful as determined by City, City shall serve notice to all Signatory Passenger Airlines of City’s intention to make a determination within fifteen (15) days, as to how the Requesting Air Transportation Company can be accommodated on one or more of the Signatory Passenger Airlines’ Preferential Leased Premises, either individually or in combination.
All rates, fees and charges received by City from such Requesting Air Transportation Company shall be considered and applied as Non- Airline Revenues.
Airline shall accommodate such Requesting Air Transportation Company on all or such portion of the Airline’s Preferential Use Premises in a commercially reasonable manner taking into account the nature of both Airline and Requesting Air Transportation Company’s respective operations, which manner of accommodation shall be subject to the review and approval of City.
Airline agrees to reasonably consider a request by a Requesting Air Transportation Company to sublease or jointly use Airline’s Leased Premises and for handling.
If available, XXXX shall xxxxx the Requesting Air Transportation Company the use of Common Use Gates, ticket counter, office, baggage make-up and related terminal space that are not currently under lease to another airline serving the Airport.
Once a decision is made, the Airport Director shall send written notice to the Air Transportation Company selected to accommodate the Requesting Air Transportation Company to begin accommodating such Requesting Air Transportation Company within fifteen (15) business days of receiving notice directing such accommodation unless it can be shown to the satisfaction of the Airport Director that a longer period of time will be necessary in order to accommodate schedule or other operational changes.
During the period of and in connection with any such accommodation, CITY shall require the Requesting Air Transportation Company to agree in writing to indemnify CITY and AIRLINE in the manner and to the extent required of AIRLINE pursuant to Section 10.03 and name Airline as an additional insured on its liability insurance.
Airline shall not impose unreasonable terms or excessive charges on the Requesting Air Transportation Company for sublease, joint use or handling.
AIRLINE may assess the Requesting Air Transportation Company reasonable rentals, fees, and charges for an accommodation which rentals, fees, and charges shall be no more than one hundred and fifteen percent (115%) of AIRLINE's costs for the Premises.
If there is insufficient Common Use Gates and other space available, the Airport Director shall notify all Signatory Passenger Airlines serving the Airport of any Requesting Air Transportation Company.
