The Purchaser agrees that initially, prior to completion of the entire Scheme, the phase in which the Property is located (along with all other completed phases, if any) will be a stand-alone Housing Development Scheme (as referred to in the Retired Person's Act).
The scheme is governed by the Housing Development Schemes for Retired Persons Act No. 65 of 1988.

The Parties acknowledge that this Agreement, including all Annexures, is compliant with the provisions of the Retired Persons Act, and in particular acknowledge the provisions of Annexure A hereto and more specifically the rights contained in Section 4(3) of the Act (relating to the statutory requirements to be contained in this agreement) and Sections 8 and 9 (relating to the cancellation of contracts and statutory relief) of the Act.

Act As applied to this policy and the interested parties being subject to either: • Sectional Title Schemes Management Act No. 8 of 2011; or • Community Schemes Ombud Service Act; or • The Companies Act 71 of 2008 (or as may be amended); or • The Shareblocks Control Act No. 59 of 1980 (or as may be amended); or • The Housing Development Schemes for Retired Persons Act No. 65 of 1988 (or as may be amended) whichever is applicable having reference to the context in which the Act is used.
