Retry Fee Class definition

Retry Fee Class means those current or former members of Defendant who
Retry Fee Class means all current or former customers of Defendant who were assessed a Retry Fee during the Class Period. Excluded from the Retry Fee Class are Defendant, its parents, subsidiaries, affiliates, officers and directors; all Retry Fee Class members who make a timely election to be excluded; and all judges assigned to this litigation and their immediate family members.
Retry Fee Class means those current or former members of Defendant who were assessed Retry Fees from January 4, 2019, through June 30, 2022.

  • The fees and expenses shall constitute full satisfaction of any obligation on the part of Defendant to pay any person, attorney, or law firm for attorneys’ fees, costs, or any other expense incurred on behalf of Named Plaintiffs, the APSN Fee Class, the Retry Fee Class, or Class Counsel in this Action, and which are approved by the Court.

  • Named Plaintiffs shall propose and recommend to the Court that the APSN Fee Class and the Retry Fee Class be certified for purposes of implementing the terms of the settlement provided for in this Agreement.

Excluded from the Retry Fee Class is Defendant, its parents, subsidiaries, Affiliates, officers, and directors; all individuals or entities who make a timely election to opt out or be excluded from the Retry Fee Class; and all judges assigned to this Action and their immediate family members.
Retry Fee Class means those current and former customers of Defendant who are residents of or had Accounts in any state, and who were assessed one or more Retry Fees between June 6, 2004 and August 31, 2018. Excluded from the Retry Fee Class is Defendant, its parents, subsidiaries, Affiliates, officers, and directors; all individuals or entities who make a timely election to opt out or be excluded from the Retry Fee Class; and all judges assigned to this Action and their immediate family members.
Retry Fee Class means those current or former members of Defendant who were assessed Retry Fees.
