Said Sale Agreement definition

Said Sale Agreement means the Agreement made between the Vendors herein, therein also referred to as the Vendors of the First Part, the Builder herein, therein also referred to as the Builder of the Second Part, and the Purchasers herein, therein also referred to as the Purchasers of the Third Part whereby the Vendors and the Builder have agreed to sell and the Purchasers have agreed to purchase the Said Flat and or for the consideration and on the terms and conditions, as therein contained.

Said Sale Agreement means the Agreement dated [•] registered with the [•] in Book No. I, Volume No. [•], Pages [•] to [•], Being No. [•] for the year [•] made between the Owners herein, therein also referred to as the Owners of the First Part, the Promoter herein, therein also referred to as the Promoter of the Second Part, and the Allottee herein, therein also referred to as the Allottee of the Third Part, whereby the Owners and the Promoter have agreed to sell and the Allottee has agreed to purchase the Said Apartment at and for the consideration and on the terms and conditions, therein contained copy whereof is attached herewith and made part of this Agreement.

Said Sale Agreement means the Agreement dated made between the Promoter herein, therein also referred to as the Promoter of the Second Part, and the Allottee herein, therein also referred to as the Allottee of the Third Part, whereby the Promoter agreed to sell and the Allottee agreed to purchase the Said Unit at and for the consideration and on the terms and conditions, therein contained.

• The Promoter had therefore demanded the amount being the excess money to be paid by the Purchaser or the promoter has therefore cause to refund the excess money as paid by the Purchaser (after all dues are cleared) as mentioned in Clause 10 of the Said Sale Agreement.

• The Allottee shall abide by, observe and perform all rules regulations and restrictions from time to time and at all times during his period of ownership of the Said Apartment made in force by the Promoter or the Association (including those contained in the Said Sale Agreement and in these presents) or the appropriate authorities for the user and management of the Project and every part thereof and in particular the Common Areas.

• The Allottee agrees and binds himself that the Allottee shall and will at all times hereafter abide by and observe the restrictions set-forth in the FIFTH SCHEDULE hereunder written and also those as contained in the Said Sale Agreement.

• SELLER warrants that its products, are free of defects in workmanship and material and fit for the uses set forth in SELLER's catalog or in product specifications, under the normal use and service for which they are intended.

• The Allottee shall abide by, observe and perform all rules regulations from time to time and at all times during his period of ownership of the Said flat/shop made in force by the Promoter or the Association (including those contained in the Said Sale Agreement and in these presents) or the appropriate authorities for the user and management of the Project and every part thereof and in particular the Common Areas.

• Now at the request of the Purchasers, the Vendors and the Builder have in terms of the Said Sale Agreement agreed to execute and register these presents in favour of the Purchasers in the manner as hereinafter contained.
