Sanctions for Sexual Assault Although it is not possible to outline the specific sanctions that will be imposed in all sexual assault cases, the following sexual assault sanctioning guidelines have been established to provide notice to the College community and provide context for the Sanctioning Officer or process in determining appropriate sanctions.
In the event of a finding of responsibility, the Title IX Coordinator will provide any such statement(s) to the Sanctioning Officer.
The Title IX Coordinator, Investigator(s), or Hearing Officer or Sanctioning Officer had a conflict of interest or bias for or against Complainants or Respondents generally or the individual Complainant or Respondent that affected the outcome of the matter.
For student Respondents, the Sanctioning Officer is the Assistant Vice President for Student Affairs.
Sanctioning Officer: A fair and impartial decision-maker responsible for determining the sanction following a finding of responsibility by a Hearing Officer.
This decision is at the discretion of the Sanctioning Officer and will only be considered if the student’s presence on campus is deemed not to be a threat.
The Sanctioning Officer is responsible for reviewing the written notice of outcome, the investigation report, any mitigation or impact statements submitted by the parties, and all other submissions from the parties, and determining the appropriate sanction.
For findings of responsibility, the Title IX Coordinator will issue the written notice of outcome to the Complainant, Respondent and Sanctioning Officer.
The Sanctioning Officer will draft a sanctioning determination that will include the findings, sanction(s) and the rationale for each sanction and will forward it to the Title IX Coordinator within ten (10) business days of the conclusion of the Hearing (or longer for good cause) for simultaneous distribution to the parties.
Hearing Officers, when also acting as the Sanctioning Officer, may assign sanctions as appropriate.
