Any breach of discipline by a member of the school administrative and support staff being dealt with in accordance with clause 14 (2) of the Teaching Service Regulation 2001 (as applied by clause 5 of the Education (School Administrative and Support Staff) Regulation 2003) before the repeal of clause 14 (2) by the amending Act is to be dealt with under Part 6 of this Act (as substituted by the amending Act) as if the breach of discipline was the subject of an allegation of misconduct made under that Part.

The Department has Guidelines for the Management of Conduct and Performance which apply generally to: officers (permanent employees) who are employed under the Teaching Service Act 1980 persons who are permanently employed under the Education (School Administrative and Support Staff) Act 1987.

The disciplinary process for permanent employees employed under the Teaching Service Act 1980 and the Education Regulation 2012, the Education (School Administrative and Support Staff) Act 1987 is outlined in the Guidelines for the Management of Conduct and Performance.
This rule in relation to allegations of misconduct is reflected in section 93D and 93F of the Teaching Service Act 1980, section 22F and 22H of the Technical and Further Education Commission Act 1990 and section 30 and 32 of the Education (School Administrative and Support Staff) Act 1987.
