In the event of a failure of the ERS system on board the Seychelles vessel, the master and/or the owner shall provide for repair or replacement of the ERS system within 10 days.
If the Seychelles vessel is performing a port call in the 10-day-period, it may resume fishing activities in the EU fishing area when the ERS system becomes fully functional again without an authorisation issued by the EU.
The Seychelles shall immediately inform the master and/or the owner of the Seychelles vessel, or his representative, of any technical failure of the ERS system installed on board the vessel or non-function of the ERS; data shall be transmitted between the vessel and the Seychelles FMC.

The Seychelles Fisheries Monitoring Centre (FMC) shall automatically and without delay forward time critical ERS messages (COE, COX, PNO) received from the Seychelles vessel to the EU FMC.
For the purposes of this Annex, the duration of a trip by a Seychelles vessel shall be defined as follows: — the period elapsing between entering and leaving EU waters, — the period elapsing between entering EU waters and a transhipment, or — the period elapsing between entering EU waters and a landing in the EU.
