Shephardizing definition
Shephardizing means researching what became of a reported decision subsequently. Was it overturned on appeal? Was it followed in another case, in the sense of one or more of its holdings/findings being cited as a guiding precedent? Were its holdings/findings/reasoning cited with approval or disapproval in another case, particularly in a decision of a higher level court? Therefore, how much precedential value or weight does the decision, in particular a West key aspect of the decision, carry going forward?
