Silver Point definition

Silver Point means Silver Point Finance, LLC.

Silver Point as defined in the preamble hereto.

Silver Point means Silver Point Capital Fund, L.P, a Delaware limited partnership headquartered in Greenwich, Connecticut, its successors and assigns, and its subsidiaries, divisions, groups, affiliates, partnerships and joint ventures, and their directors, officers, managers, agents, and employees.

• This Agreement may not be used, circulated, quoted or otherwise referred to in any document, except with the written consent of each of the Company and each of the Silver Point Funds.

• This Agreement may be amended, modified, or waived with the written consent of each of the Silver Point Funds and the Company.

• Each Silver Point Fund acknowledges and agrees that (a) irreparable damage would occur in the event that any of the provisions of this Agreement are not performed in accordance with their specific terms or are otherwise breached, and (b) remedies at law would not be adequate to compensate the non-breaching party.

Silver Point means SPCP Group, LLC, its affiliates, members, assigns, joint venturers, partners, directors, officers, employees, accountants, representatives, agents, attorneys, law firms, and investigators, acting or purporting to act on its behalf.
