  • The Parties acknowledge that PRFN asserts the construction and development of the Site C Project and its Operation was approved by British Columbia and commenced by BC Hydro prior to obtaining PRFN’s free, prior, and informed consent.

  • If BC Hydro determines, at any time and in its sole discretion, to delay, suspend or abandon the Site C Project and its Operation, British Columbia may, in its sole discretion, on 60 days’ prior notice to PRFN and BC Hydro, delay or suspend the transfer of the Lands.

  • PRFN may retain any Lands transferred to it by British Columbia before the termination of this Agreement or the abandonment of the Site C Project and its Operation.

  • This Agreement commences on the Effective Date and continues until completion of decommissioning of the Site C Project and its Operation, unless terminated under 3.3 or 22.2.

  • If BC Hydro determines, at any time and in its sole discretion, to recommence the Site C Project and its Operation following a delay or suspension, BC Hydro will promptly deliver notice of recommencement to PRFN and British Columbia and British Columbia’s obligations regarding the transfer of any Lands which have not been completed will resume upon receipt of BC Hydro’s notice that it has recommenced the Site C Project and its Operation.

  • Any Lands transferred by British Columbia to HRFN or any Land Management Measures implemented by British Columbia before the abandonment of the Site C Project and its Operation will be deemed to constitute adequate consultation and accommodation with respect to any potential adverse impact on, or any infringement of, HRFN’s Section 35 Rights resulting from the activities carried out before the abandonment of the Site C Project or its Operation.

  • This Agreement commences on the Effective Date and continues for the life of the Site C Project and its Operation, unless terminated under 3.2.

  • BC Hydro and British Columbia will continue to engage PRFN regarding any concerns or interests that PRFN may have in relation to new Authorizations or renewals, replacements, or amendments to existing Authorizations for the Site C Project and its Operation and will continue to consider in good faith proposals made by PRFN which seek to avoid or otherwise mitigate any Impacts such Authorizations may have on PRFN Section 35 Rights.

  • British Columbia will not be liable for or otherwise obligated to reimburse BC Hydro for any costs incurred by BC Hydro under 11.2 or 11.3, including any survey costs, in the event the Site C Project and its Operation is delayed, suspended or abandoned under 3.2.

  • Nothing in this Agreement will be construed so as to deprive DRFN of any right it may have to participate in any permitting, regulatory or other government decision-making process related to the issuance or renewal of any Authorization for the Site C Project and its Operation.

Related to Site C Project and its Operation

  • Project means the goods or Services described in the Signature Document or a Work Order of this Contract.

  • Ongoing Project means a multi-year project undertaken by a Company in fulfilment of its CSR obligation having timelines not exceeding three years excluding the financial year in which it was commenced, and shall include such project that was initially not approved as a multi-year project but whose duration has been extended beyond one year by the board based on reasonable justification;

  • Projects means the projects identified in Exhibit A to the Agreement and all other projects, any costs of which are included in a Transitional Capital Plan pursuant to the Act or are Recovery Costs, and financed, by payment or reimbursement, with the proceeds of Bonds or Notes.

  • Development Project means a project for the development of land within a project area.

  • The Works/Project means the works to be executed or done under this contract.

  • Pilot project means an innovative environmental project that covers one or more designated facilities, designed and implemented in the form of an EMSA. (See Section 52.3 of the Act.)

  • Project Water means water made available for delivery to the contractors by project conservation facilities and the transportation facilities included in the System.

  • New Project means (a) each facility which is either a new facility, branch or office or an expansion, relocation, remodeling or substantial modernization of an existing facility, branch or office owned by the Borrower or its Subsidiaries which in fact commences operations and (b) each creation (in one or a series of related transactions) of a business unit to the extent such business unit commences operations or each expansion (in one or a series of related transactions) of business into a new market.

  • Construction Phase Services means the coordination, implementation and execution of the Work required by this Agreement, which are further defined in Article 8.

  • Project area budget means a multiyear projection of annual or cumulative

  • Expansion Project has the meaning set forth in Section IV.3.a of this Agreement.

  • Research Project means a discrete scientific endeavor to answer a research question or a set of research questions related to medical marijuana and is required for a medical marijuana research license.

  • Project Improvements means site improvements and facilities that are:

  • Redevelopment Project Area means an area designated by the municipality, which is not less in the aggregate than 1 1/2 acres and in respect to which the municipality has made a finding that there exist conditions which cause the area to be classified as an industrial park conservation area or a blighted area or a conservation area, or a combination of both blighted areas and conservation areas.

  • Construction project means the same as that term is defined in Section 38-1a-102.

  • Redevelopment project means a specific construction project

  • Project Work means the work required to complete the Project.

  • Project Assets means all physical and other assets relating to (a) tangible assets such as civil works and equipment including foundations, embankments, pavements, road surface, interchanges, bridges, culverts, road over-bridges, drainage works, traffic signals, sign boards, kilometre-stones, [toll plaza(s)], electrical systems, communication systems, rest areas, relief centres, maintenance depots and administrative offices; and (b) Project Facilities situated on the Site;

  • Project Land means any parcel or parcels of land on which the project is developed and constructed by a promoter;

  • Approved Project means the Scheme application of the Applicant approved by the CIC.

  • The Works/ Project means the works to be executed or done under this contract.

  • Research facility means buildings and structures, including machinery and equipment, used or to be used primarily for research or experimentation to improve or develop new tangible goods or materials or to improve or develop the production processes thereto.

  • The Project Plan means the document to be developed by the Supplier and approved by the Purchaser, pursuant to GCC Clause 19, based on the requirements of the Contract and the Preliminary Project Plan included in the Supplier’s bid. The “Agreed and Finalized Project Plan” is the version of the Project Plan approved by the Purchaser, in accordance with GCC Clause 19.2. Should the Project Plan conflict with the Contract in any way, the relevant provisions of the Contract, including any amendments, shall prevail.

  • Project Area means land or lands located within the incentive

  • Project Budget means the budget and project description included in the grant application. The Project Budget must succinctly describe all major elements of project work, the estimated cost of each, and clearly allocate requested grant funding and match contributions to each.

  • Production Operations means all operations conducted for the purpose of producing Petroleum from the Development Area after the commencement of production from the Development Area including the operation and maintenance of all necessary facilities therefor.
