The Appeal shall be governed by the Arbitration Act 1996 and Sport Resolutions (UK)’s Appeal Arbitration Rules, which Rules are deemed to be incorporated by reference to this clause.
The Appeal shall be conducted under Sport Resolutions UK’s Appeal Arbitration Rules, as amended by the provisions of this Procedure.
Where an appeal is lodged in response to a safeguarding decision made by the LTA Safeguarding Team and Safeguarding and Protection Committee and/or Licensing and Registration Committee, an independent appeal body such as Sport Resolutions may be used.
The selection appeal will then as soon as possible be referred to Sport Resolutions (UK) for determination by way of binding, confidential, arbitration.

In the event that the Evaluation Committee decides to refer an Appellant’s appeal for a decision by a sole arbitrator in accordance with paragraph 4.3, it shall be referred to Sport Resolutions (UK) for final and binding arbitration by a sole arbitrator in accordance with the Appeal Arbitration Procedure set out in Sport Resolutions (UK)’s Arbitration Rules, save as amended by the provisions of this Appeal Procedure (the Arbitration).
The parties shall seek to agree on one, whom they shall nominate to be appointed by the Executive Director of Sport Resolutions (UK).
