Where an appeal is lodged in response to a safeguarding decision made by the LTA Safeguarding Team and Safeguarding and Protection Committee and/or Licensing and Registration Committee, an independent appeal body such as Sport Resolutions may be used.
The Appeal shall be conducted under Sport Resolutions UK’s Appeal Arbitration Rules, as amended by the provisions of this Procedure.
Upon receipt of the Notice of Second Appeal, the Performance Operations Manager will notify Sport Resolutions (UK) as soon as possible and provide Sport Resolutions (UK) with a copy of the Notice of Second Appeal.
The Applicant may within twenty-one (21) days of the receipt by it of any Counterclaim, submit to Sport Resolutions and serve on the Respondent a defence to such Counterclaim (the “Defence to Counterclaim”).
The Appeal shall be governed by the Arbitration Act 1996 and Sport Resolutions (UK)’s Appeal Arbitration Rules, which Rules are deemed to be incorporated by reference to this clause.
In the absence of a time-limit set in the regulations of the sports body concerned or of a previous subsisting agreement, the time-limit for the receipt by Sport Resolutions and for the service by the Appellant on the Respondent of the Notice of Appeal shall be twenty-one (21) days from the date of the decision from which the appeal is made or to be made.
The written decision and its reasons shall be communicated by the Tribunal to the parties via Sport Resolutions as soon as possible and ordinarily within two (2) months after the receipt by Sport Resolutions of the Notice of Appeal, unless the parties otherwise agree.
The Decision/Award will not be released by Sport Resolutions to any party until all invoiced payments have been paid in full.
