Notwithstanding anything set forth herein, this Stapled Security and the Notes and Common Shares that underlie this Stapled Security may not be acquired by any Subsidiary of the Company unless such Subsidiary is at the time treated as an entity disregarded as separate from the Company for U.S. federal income tax purposes.
In addition, upon the acquisition of a Stapled Security by the Company or any Subsidiary of the Company that is treated as an entity disregarded as separate from the Company for U.S. federal income tax purposes, the Common Shares and Notes associated with such Stapled Security will automatically separate.
