New Note definition

New Note shall have the meaning assigned to such term in Section 38.

New Note shall have the meaning set forth in Section 9.1.5 hereof.

New Note means a New Convertible Note or a New Senior Note.

• Any New Note that is created in a resizing contemplated by this Section 33 and is not the Controlling Note shall be deemed to be a Non-Controlling Note under this Agreement, the definitions of “Non-Controlling Note” and “Non-Controlling Note Holder” shall be deemed to have been revised accordingly to include such New Notes, and the applicable Note Holders of such Non-Controlling Notes shall have the same rights and responsibilities as all other Non-Controlling Note Holders.

New Note has the meaning stated in Section 3.9.

New Note or “New Notes” means any New Note or New Notes, as the case may be, authenticated and delivered under this Indenture, including any Global Note.
