Subsequent Acquisition Transaction definition

Subsequent Acquisition Transaction has the meaning set out in Section 2.6;
Subsequent Acquisition Transaction means an amalgamation, statutory arrangement, merger or other combination involving Frontier and the Offeror and/or one or more affiliates or subsidiaries of the Offeror or a share consolidation pursuant to which the Offeror will use its commercially reasonable efforts to acquire the remaining Shares not acquired under the Offer as soon as practicable after completion of the Offer if the Offeror take up and pays for Shares validly deposited under the Offer and the statutory right of Compulsory Acquisition is not available;
Subsequent Acquisition Transaction means, after Bidco takes up and pays for Shares validly deposited under the Offer and the Compulsory Acquisition is not available or not exercised, the acquisition by way of an amalgamation, plan of arrangement, capital reorganization or other transaction involving Target and Bidco and/or one or more affiliates of Bidco of all Shares not acquired by Bidco pursuant to the Offer.

Subsequent Acquisition Transaction means any proposed arrangement, amalgamation, merger, reorganization, consolidation, recapitalization or other transaction involving the Corporation and/or its subsidiaries and the Offeror or an affiliate of the Offeror which, if successfully completed, will result in the Offeror owning, directly or indirectly, all of the Shares and/or all of the assets of the Corporation;
