Examples of Supplemented Indenture in a sentence
Upon the execution and delivery of this First Amending Supplemental Indenture by the Company, the Guarantor and the Trustee, the Supplemented Indenture shall be supplemented and amended in accordance herewith, and this First Amending Supplemental Indenture shall form a part of the Supplemented Indenture for all purposes and every Holder of a Security heretofore or hereafter authenticated and delivered under the Supplemented Indenture shall be bound thereby.
All amendments to the Supplemented Indenture made hereby shall have effect only with respect to the Securities.
Parent hereby irrevocably and unconditionally agrees to be bound by the terms of this First Supplemented Indenture applicable to it and to issue Parent Shares as necessary to satisfy the Company’s obligations with respect to any Notes validly surrendered for conversion pursuant to Article 14 of the Original Indenture.
To the extent that the Supplemented Indenture (including the Guarantee) constitutes general conditions within the meaning of Section 6:231 CC, a beneficiary of the Guarantee may nullify ( vernietigen) a provision therein if (i) the beneficiary has not been given a reasonable opportunity to examine the Supplemented Indenture, or (ii) the provision, having regard to all relevant circumstances, is unreasonably onerous to the holder.
The Supplemented Indenture is hereby incorporated by reference herein and, as further supplemented by this Seventh Supplemental Indenture, is in all respects adopted, ratified and confirmed.
