Examples of Taking Termination Date in a sentence
If Tenant elects to timely deliver the Taking Termination Notice, there shall be no abatement of Rent prior to the Taking Termination Date.
This Lease shall remain in full force and effect prior to the Taking Termination Date.
In the event that Tenant terminates this Lease pursuant to the foregoing sentence, such termination shall be effective upon the date that possession is required to be surrendered to the applicable authority (the "Taking Termination Date").
In such event, on the Taking Termination Date (A) Tenant shall deliver to Landlord the Taking Termination Payment, (B) this Lease and the Term hereof shall terminate, (C) Tenant shall have no obligation to commence or complete the restoration of the Improvements, and (D) all of the award payable in connection with the Material Taking shall be paid to Landlord.
The Redemption Date for Notes to be redeemed pursuant to this Section 6.1(b)(i) shall be the Casualty Termination Date or the Taking Termination Date, as the case may be.
In such event, on the Taking Termination Date (A) Landlord shall be in receipt of the Taking Termination Payment, (B) this Lease and the Term hereof shall terminate, (C) Tenant shall have no obligation to commence or complete the restoration of the Improvements, and (D) all of the award payable in connection with the Material Taking shall be paid to Landlord.
Notwithstanding anything to the contrary set forth in this Section 22.04, if any Temporary Taking shall continue for a period in excess of 150 days, Tenant may terminate this Lease by delivery of notice to Landlord on or after the date which shall be 150 days after the Date of Taking but in no event later than 210 days after the Date of Taking (the "Temporary Taking Termination Date").
Upon the giving of such notice by Tenant, this Lease shall terminate on the Temporary Taking Termination Date, and the rents shall be prorated as of such date.
Lessee must exercise such option by delivering written notice to Lessor (the "Taking Termination Notice") not later than ninety (90) days after the effective date of such Taking (which, for purposes hereof, shall mean the earlier of delivery of possession or transfer of title to the condemning authority, unless, in the case of prior transfer of title, Lessee is permitted to continue occupying the Leased Property until delivery of possession) (the "Taking Termination Date").
