The Plan Administrator will include in the ACP test as a zero an ACP Participant who for the Testing Year: (i) is eligible to make Employee Contributions but who does not do so; or (ii) is eligible to make Elective Deferrals and to receive an allocation of any Matching Contributions based on Elective Deferrals but who does not make any Elective Deferrals.
A forfeiture under this Section 3.07(A)(1)(c) occurs no later than the Plan Year following the Testing Year and the forfeiture is allocated in the Plan Year described in Section 3.07(B).
