In the event the PURCHASER decides not to exercise his right of preference or simply does not answer in writing the VENDOR’S notification of this latter’s intention of sale within the described time term, he will be free to go ahead and sell the SHARES in the corresponding stock market, heeding to the adjustment process of amount of shares and guaranteed price per share described in the above Third Clause.

THIRD PARAGRAPH --------------- The interest related to the parcel of credit foreseen in topic II of Third Clause of this Amendment must be capitalized on the 15th of each month since the release of the funds until the 15th immediately before the beginning of the amortization of the referred parcel of credit and will be chargeable monthly along with the respective amortization of main.
Each party will make every effort to raise funds from diverse sources in order to make possible the co-operation programmes, in the terms of the Third Clause.

The Parties agree that this capacity decrease is in accordance with the terms and conditions of the CAPACITY COMMITMENT established in the Third Clause of the Fourteenth Amendment.
Such remedies shall, however, be cumulative and not exclusive and shall be in addition to any other remedies which a Party may have under this Agreement (including the right to terminate in accordance with Clause 16 (Termination) or otherwise).
