Use of De-identified information. De-identified information may be used by the Contractor for the purposes of development, research, and improvement of educational sites, services, or applications, as any other member of the public or party would be able to use de-identified data pursuant to 34 CFR 99.31(b). Contractor agrees not to attempt to re-identify de-identified Student Data.

Provider agrees not to attempt to re-identify de-identified Division Data and not to transfer de-identified Division Data to any party unless (a) that party agrees in writing not to attempt re-identification, and (b) prior written notice has been given to the Division who has provided prior written consent for such transfer.

Provider shall not copy, reproduce or transmit any data obtained under the Service Agreement and/or any portion thereof, except as necessary to fulfill the Service Agreement.

De-identified information may be used by the Contractor for the purposes of development, research, and improvement of educational sites, services, or applications, as any other member of the public or party would be able to use de- identified data pursuant to 34 CFR 99.31(b). Contractor hereby provides notice to LEA that it shares de-identified information, solely for the purposes authorized in this Section, with third-party service providers. During the school year, Contractor may share de-identified information with other third- party consultants who, by contract with Contractor, provide research support to Contractor to improve Zearn Math. All such providers and consultants agree not to re-identify or attempt to re- identify de-identified information shared with it. Contractor agrees not to attempt to re-identify de- identified Student Data.
Use of De-identified information. In the first sentence of Section 4 (De-identified information) of Article III (Duties of Contractor), “De-identified information” is hereby replaced with the defined term from the DPA “De-Identified Information”.
Use of De-identified information. BeamReaders may de-identify any and all information related to the Services in accordance with 45 C.F.R. § 164.514(b). Practice acknowledges and agrees that de-identified information is not protected health information pursuant to 45 C.F.R. § 164.514(a), and that BeamReaders may use such de-identified information for any lawful purpose including but not limited to education or research purposes.

De-identified Information may be used by NoRedInk for the purposes of development, research, and improvement of educational sites, services, or applications, as set forth in the Agreement. NoRedInk will not attempt to re-identify De-identified Information and will not transfer De-identified Information to any party (other than a NoRedInk subcontractor in connection with the provision of the Services or as part of an assignment of the Agreement) unless: (a) the De-Identified Information is either aggregated with other similar data so that neither the identity of Client nor the identity of any natural person can reasonably be derived; or
