Use or consumption means the exercise of any right or power

Use or consumption means “the exercise of any right or power over cigarettes or tobacco products incident to the ownership thereof.” Id. § 30009. However, “use or consumption” excludes the “the keeping or retention” of such products “by a licensed distributor for the purpose of sale.” Id. § 30009.
