Vx Server Edition definition

Vx Server Edition means the Pervasive PSQL Vx Server Edition software You have received from Pervasive with this Agreement that operates on a Server which may be incorporated into a Communications Network, including all applicable Updates.
Vx Server Edition means the Software designated as PSQL Vx Server Edition in an Order and that You have received from Actian with this Agreement that operates on a Server which may be incorporated into a Communications Network, including all applicable Updates.

Examples of Vx Server Edition in a sentence

  • Notwithstanding anything to the contrary in this Agreement, there are no restrictions on use of the Vx Server Edition as a “software as a service”, in an application service provider environment, and/or on the Internet or Intranet or by multiplexing (as defined below).

  • If You use hardware or software to pool connections, reroute information, and reduce the number of Devices, Servers or users that directly access or use the Server Software, or reduce the number of Devices, Servers or users the Server Software directly manages (sometimes referred to as “multiplexing” or “pooling”), then You are required to purchase the Vx Server Edition Capacity-based License.

  • If You have properly licensed the Server Edition and/or the Vx Server Edition and if the Server running such software has failed, Actian grants to You a nonexclusive, nontransferable, nonsublicensable and revocable right to no more than three (3) limited consecutive terms of up to seven (7) consecutive days per term to use a replacement copy of such software provided by Actian (the “Insurance Software”) in accordance with the applicable licenses granted herein.

  • If You cannot accurately track the number of Concurrent Users accessing the Server Edition under the Concurrent User License and maintain appropriate Records in accordance with Section 11.4 below, then You must purchase a Vx Server Edition License.

  • If You cannot accurately track the number of Concurrent Users accessing the Workstation/Workgroup Edition under the Concurrent User License and maintain appropriate Records in accordance with Section 11.4 below, then You must purchase a Vx Server Edition License.

  • Oftentimes, someone with receptive aphasia takes figura- tive language literally.

  • If You cannot accurately track the number of Concurrent Users accessing the Server Edition under the Concurrent User License and maintain appropriate Records in accordance with Section 12.6 below, then You must purchase a Vx Server Edition License.

  • If You cannot accurately track the number of Concurrent Users accessing the Workstation/Workgroup Edition under the Concurrent User License and maintain appropriate Records in accordance with Section 12.6 below, then You must purchase a Vx Server Edition License.

  • Notwithstanding anything to the contrary in this Agreement, there are no restrictions on use of the Vx Server Edition as a “software as a service”, in an application service provider environment, and/or on the Internet or Intranet.

  • For Vx Server Edition, You are required to enable Internet access in order to permit automatic periodic validation by Pervasive.

Related to Vx Server Edition

  • Support Service means an activity, such as information technology, accounting, human resources, legal, and other support functions that are required to support the ongoing delivery of core services.

  • Service Drop means a cable that, by its design, capacity and relationship to other cables of the Company, can be reasonably considered to be for the sole purpose of connecting backbone of the Equipment to not more than one individual customer or building point of presence or property;

  • Black Start Service means the capability of generating units to start without an outside electrical supply or the demonstrated ability of a generating unit with a high operating factor (subject to Transmission Provider concurrence) to automatically remain operating at reduced levels when disconnected from the grid.

  • Distribution Service means the delivery of electricity to Customers by the Distribution Company.

  • Self-service display means the open display or storage of Tobacco Products or Tobacco Paraphernalia in a manner that is physically accessible in any way to the general public without the assistance of the retailer or employee of the retailer and a direct person-to-person transfer between the purchaser and the retailer or employee of the retailer. A vending machine is a form of Self-Service Display.

  • Electronic Funds Transfer (EFT) indicator means a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management records for identifying alternative EFT accounts (see subpart 32.11) for the same entity.

  • Video programming means programming provided by, or generally considered comparable to programming provided by, a television broadcast station.

  • Centralized Message Distribution System (CMDS) means the industry-wide data collection system, which handles the daily exchange of message details between CMDS participating telephone companies (also known as CMDS Direct Participants). AT&T-21STATE is a CMDS Direct Participant.

  • Database Management System (DBMS) A system of manual procedures and computer programs used to create, store and update the data required to provide Selective Routing and/or Automatic Location Identification for 911 systems. Day: A calendar day unless otherwise specified. Dedicated Transport: UNE transmission path between one of CenturyLink’s Wire Centers or switches and another of CenturyLink’s Wire Centers or switches within the same LATA and State that are dedicated to a particular customer or carrier. Default: A Party’s violation of any material term or condition of the Agreement, or refusal or failure in any material respect to properly perform its obligations under this Agreement, including the failure to make any undisputed payment when due. A Party shall also be deemed in Default upon such Party’s insolvency or the initiation of bankruptcy or receivership proceedings by or against the Party or the failure to obtain or maintain any certification(s) or authorization(s) from the Commission which are necessary or appropriate for a Party to exchange traffic or order any service, facility or arrangement under this Agreement, or notice from the Party that it has ceased doing business in this State or receipt of publicly available information that signifies the Party is no longer doing business in this State.

  • Online Service means our on-line system for managing the electronic transmission of information between us and Providers;

  • Video service means video programming, cable services, IPTV, or OVS provided through facilities located at least in part in the public rights-of-way without regard to delivery technology, including internet protocol technology. This definition does not include any video programming provided by a commercial mobile service provider defined in 47 USC 332(d) or provided solely as part of, and via, a service that enables users to access content, information, electronic mail, or other services offered over the public internet.

  • Distribution Services means the service of distribution, as defined in section 5 of the Act;

  • Payment Initiation Service Provider or “PISP” means an authorised third party provider which provides a service that allows that third party to pass payment instructions to us on your behalf in relation to your Account.

  • Generation Service means the sale of electricity, including ancillary services such as the provision of reserves, to a Customer by a Competitive Supplier.

  • Weapon-free school zone means school property and a vehicle used by a school to transport students to or from school property.

  • Supported Web Browser means the current release from time to time of Microsoft Edge, Mozilla Firefox, Google Chrome or Apple Safari, or any other web browser that the Provider agrees in writing shall be supported;

  • Interactive computer service means any information service, system, or ac- cess software provider that provides or enables computer access by multiple users to a computer server, including specifically a service or system that provides access to the Internet and such systems operated or services of- fered by libraries or educational insti- tutions.

  • Education service provider means an education management organization, school

  • Internet Service Provider (ISP) means an Enhanced Service Provider (ESP) that provides Internet Services.

  • broadcasting service means a radiocommunication service in which the transmissions are intended for direct reception by the general public. This service may include sound transmissions, television transmissions or other types of transmission.

  • Electronic Subcontracting Reporting System (eSRS) means the Governmentwide, electronic, web-based system for small business subcontracting program reporting. The eSRS is located at http://www.esrs.gov.

  • Software Updates means the Software releases, service packs, build updates or emergency fixes released from time to time in accordance with the Vocera’s update policy for such Software.

  • Toll Free Service is service provided with any dialing sequence that invokes toll-free, 800-like, service processing, for example for illustration only, 800 or 800-like services. Toll Free Service includes but is not limited to calls placed to 800/888 NPA Service Access Codes (SAC).

  • Commercial Mobile Radio Service or "CMRS" means commercial mobile radio service regulated under section 3 of title I and section 332 of title III of the communications act of 1934, chapter 652, 48 Stat 1064, 47 USC 153 and 332, and the rules of the Federal Communications Commission or provided under the wireless emergency service order. Commercial mobile radio service or CMRS includes all of the following:

  • System for Award Management (SAM) database means the primary Government repository for contractor information required for the conduct of business with the Government.

  • Video service provider or "provider" means a person authorized under this act to provide video service.
