The Contractor shall prosecute and complete the Contract Work in strict accordance with the Scope of Work Documents, the Drawings and Design Specifications and all other Contract Documents.
Each School District’s Scope of Work Documents are listed in Section VII: Appendices and Attachments.
It is anticipated that, in order to complete the Work in a timely manner as required in the construction schedule discussed below, the Work Documents may be developed in phases to allow for the commencement of construction as soon as possible on those aspects of the Work which will require the longest construction period.
Subject to Owner’s obligations under this Contract, Contractor warrants that the Scope of Work Documents are sufficient and suitable for the engineering, procurement, and construction, and, subject to proper operation and maintenance after Substantial Completion, operation and maintenance of the Facility.
Notwithstanding the foregoing, in order for Landlord to perform Substantial Completion, Tenant must deliver to Landlord Work Documents which have been agreed to and signed by Tenant indicating approval for construction by October 31,1995.
Tenant shall develop and shall cause the production of the Work Documents which shall set forth the design of the Premises in sufficient detail to support construction of the Work and the obtaining by Landlord of any permits or certificates required favor occupancy of the Premises.
The delay to remedy any Irrelevant Punch List and to deliver the “as built” and any other documents referred to in item 4.9. (Delivery of As Built and Work Documents) shall not result in imposition of the Fine for Delay in Work Delivery and not entitle Lessee to terminate this Agreement, considering that said obligations do not affect the Work Conclusion Date.
The Plans and Specifications are hereinafter collectively called the "Work Documents".
The cost of producing such Work Documents shall be included in the costs of the Work.
In addition, Tenant shall promptly submit the Work Documents to Landlord who shall promptly review the Work Documents submitted by Tenant and shall either provide comments or corrections thereto or approve such Work Documents.
