XXXX Capacity Damages definition

XXXX Capacity Damages means the amount the Lessor will credit to the Judicial Council in the event of under performance of the XXXX Capacity Guarantee.

Examples of XXXX Capacity Damages in a sentence

  • If the Contractor does not meet the XXXX Capacity Guarantee, the Contractor will credit the Judicial Council an amount of the XXXX Capacity Damages against the Judicial Council’s next Rent payment(s), which amount shall be calculated as the product of the under-performance and the annual Rent.

  • If the Licensee does not meet the XXXX Capacity Guarantee, the Licensee will credit the Judicial Council an amount of the XXXX Capacity Damages against the Judicial Council’s next Rent payment(s), which amount shall be calculated as the product of the under-performance and the annual Rent.
