Common use of LIMIT OF LIABILITY Clause in Contracts

LIMIT OF LIABILITY. The bodily injury liability limit for “each person” as shown in the Declarations is the maximum we will pay for bodily injury sustained by any one person in any one accident, including all derivative claims which include, but are not limited to, loss of consortium, loss of services, l oss of companionship, or i njury t o any per sonal r elationship. Bodily injury to any one person includes al l i njury and damages to others resulting from this bodily injury. Subject to the bodily injury liability limit for “each person”, the bodily injury liability limit for “each accident” as stated in the Declarations is the maximum we will pay for bodily injury sustained by two or more persons in any one accident. The property damage liability limit for each accident as stated in the Declarations is the maximum we will pay for all property damage arising out of any one accident. The limit of liability shown in the Declarations is the most we will pay regardless of the number of vehicles involved in the accident, insured persons, claims made, lawsuits brought, premiums paid, or the number of vehicles or premiums shown in the Declarations. If an insured person is operating an auto in a state which requires minimum financial responsibility limits f or nonresidents, we will increase the policy limits to the required minimum limits of that state. We will not provide any coverage under the no-fault law or any other similar law of any other state. A car and attached trailer are considered as one car. No one is entitled to duplicate payments for the same element of damages. Any amount payable under Part A-Liability Coverage to a person f or bodily injury shall be r educed by al l sums pa id to that per son, or f or t heir benef it, under P art B – Medical P ayments Coverage and Part C – Uninsured Motorist Coverage.
