POSTAGE – DISTRIBUTION OF MEDIA. 6.1 Postage costs correspond to the price of a distribution service provided by a third party, namely la Poste or any other company that might replace it in application of the order placed. The Client acknowledges being perfectly aware of the financial and technical warranty terms offered by these companies.
6.2 GOCAD SERVICES cannot be held liable for any failure by these companies to perform their duties, notably in case of change by the operators, for technical reasons, of the appearance of the transmitted messages.
6.3 The postal rate of the price for distribution of the media is the price applicable on the day of shipment in accordance with the characteristics of the media as defined by the postal norms or with those of the distributor’s applicable norms. The Client is the sole guarantor of the advertising nature of the shipped media and shall immediately pay any additional costs applied by la POSTE or the distributor or transporter so that GOCAD SERVICES is not penalised. GOCAD SERVICES’ liability cannot be claimed if the price of postage in increased due to the failure to comply with the distributor’s requirements. Final invoicing is drawn up when the real amount of postage has been provided by the distributing company taking account any possible additional postage costs. The same is true for the invoicing of costs for distribution of media in any form whatsoever.
6.4 If GOCAD SERVICES were to pay postage costs on behalf of the Client, GOCAD SERVICES is entitled to request an advance from the Client, in compliance with current practises in this field. This advance must imperatively be paid to GOCAD SERVICES before the said postage services have begun, and at least 8 working days before the date agreed by the Parties to drop off to the postal service. Failing this, the services may be legally suspended without notice by GOCAD SERVICES while awaiting payment.
6.5 The Client, acting as principal, thus acknowledges mandating GOCAD, authorised agent, which agrees to do as follows: - to incur, on behalf of and in the name of the principal, any and all postage costs necessary for sending the post for which it has been mandated by the principal; - to pay, on behalf of and in the name of the principal, the sums due to la Poste for the expenses incurred and disbursed.
